인도, 마하라쉬트라 주 시위를 범죄로 규정 (2016. 4)
마하라쉬트라 주의회에서는 만장일치로 시위 금지(예방, 금지 및 시정)법, 2016이
통과되었다. 이 법에 따르면 누구라도 이 법에서 금지하는 시위행위를 하여 범죄를 저지른 경우, 최대 3년까지의 징역형 또는 Rs1
lakh 벌금형에 처할 수 있도록 하고 있다. 마하라쉬트라주는 시위를 금지하는 법을 제정한
첫 번째 주가 되었다.
유죄가 확정된 경우에는, 피해자의 진술을
들을 이후에만 형량을 정할 수 있으며 형량은 조정가능하다고 정하고 있다. 법안이 연기되고 있던 동안에
데벤드라 파드나비스Devendra Fadnavis 장관은 지금까지
68건의 시위가 보고 되었으며, Raigad 지역의 633명이
확인되었다고 하였다. 해당 법안에 따르면 이 범죄행위는 심리되고 보석도 가능하다고 한다.
시위 예방 담당관이 이러한 사건의 예방을 위해 지정되게 된다. 예외적으로, 이 법의 시행을 위한 규정은 입법부의 승인을 받아야
한다. 법안에 따르면 피해자나 피해자 가족이라면 경찰이나 담당 부서에 직접 신고를 할 수 있다. 신속한 정의 실현을 위하여 법원은 고소일로부터 6월 이내에 재판을
완료하여야 한다.
이법의 제정으로 Bombay Regulation II of 1827; the Caste
Disabilities Removal Act, 1850; the Bombay Prevention of Ex-Communication Act,
1949은 폐지된다.

With this, Maharashtra becomes the first state in the country to bring out a
law making social boycott a crime.
If the accused is convicted, the court shall hear the victim on the quantum of
sentence and only then pass the sentence, the Bill states. The sentence is
compoundable. While tabling the Bill, chief minister Devendra Fadnavis informed
the legislative council that so far, 68 instances of social boycott have been
reported in the state and 633 people from Raigad have been identified.
"This Bill will help restrain such medieval practices," he said.
